Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website located at generationhealth.me (the “Site”) and the insurance advisory services offered by GenerationHealth, operated by Robert Simm, a licensed independent health insurance agent in the State of North Carolina (NC License #10447418, NPN #10447418).

By accessing or using the Site, requesting a quote, scheduling a consultation, or engaging our services in any manner, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our services.

These Terms apply to all visitors, users, and clients, whether browsing as a guest or engaging us for insurance advisory services.

Our Services

GenerationHealth provides independent health insurance advisory and brokerage services to individuals and families in North Carolina, including:

• Medicare Advantage (Part C) plan comparison and enrollment assistance
• Medicare Supplement (Medigap) plan comparison and enrollment assistance
• Medicare Part D prescription drug plan comparison and enrollment assistance
• ACA Marketplace (individual and family health insurance) plan comparison and enrollment assistance
• Educational content, tools, and resources related to health insurance coverage in North Carolina

Robert Simm is an independent agent contracted with multiple insurance carriers. GenerationHealth is not a captive agent of any single carrier. Carrier availability varies by county in North Carolina. Not all plans are available in all areas.

Our services are provided at no cost to you. Licensed brokers and agents are compensated by insurance carriers through commissions when a client enrolls in a plan. This compensation does not affect the premium you pay — the plan premium is identical whether you enroll through a broker or directly with the carrier.

We are licensed to sell health insurance in the State of North Carolina only. Residents of other states should consult a licensed agent in their state.

Not Legal, Financial, or Medical Advice

All content published on GenerationHealth.me, including articles, guides, comparison tools, FAQs, calculators, and educational resources, is provided for informational and educational purposes only. It does not constitute legal, financial, tax, or medical advice.

While we make every effort to ensure the accuracy and currency of the information presented on this Site, Medicare premiums, plan benefits, formularies, provider networks, and subsidy thresholds change annually and can change mid-year. Information on this Site reflects our understanding at the time of publication and may not reflect the most current plan details.

GenerationHealth does not represent or act on behalf of any government agency. References to government programs, plan types, or federal and state regulations on this Site are for educational purposes only.

Published figures for Medicare Part B premiums, Part D out-of-pocket caps, and other federal benchmark amounts reflect CMS-published figures at the time of content publication and may be updated.

The Site and its content are provided on an “as is” basis. We reserve the right to modify, update, or remove content from the Site at any time without notice.

• Interruption or unavailability of the Site

• Healthcare costs or coverage gaps arising from enrollment decisions

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE USE OF THE SITE OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (WHICH IS TYPICALLY $0, AS OUR ADVISORY SERVICES ARE FREE TO CLIENTS) OR (B) $100.

Some jurisdictions do not allow the limitation of certain damages. If you reside in such a jurisdiction, some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless GenerationHealth, Robert Simm, and their respective agents, employees, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Site or our services
• Your violation of these Terms
• Your violation of any applicable law, regulation, or the rights of any third party
• Any content you submit or transmit through the Site

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms, the Site, or our services shall first be attempted to be resolved through good-faith negotiation between the parties. If such negotiation fails, disputes shall be resolved in the state or federal courts located in Durham County, North Carolina. You consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

Changes to These Terms

We reserve the right to update or modify these Terms at any time in our sole discretion. When we make material changes, we will update the “Last Updated” date at the top of this page.

Your continued use of the Site or our services following the posting of any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

If you have an existing engagement or enrollment in progress when Terms change, those changes will apply to future use of the Site but will not retroactively alter the terms of your prior engagement.
