GenerationHealth and Robert Simm operate as an independent insurance agency and broker. This means:
- Robert Simm is not a captive or exclusive agent of any single insurance carrier
- Robert Simm is not an employee, contractor, or representative of any insurance carrier
- GenerationHealth is not owned by, affiliated with, or controlled by any insurance carrier
- Robert Simm is appointed with multiple carriers and can compare plans across all carriers for which he holds an active appointment
- Plan recommendations are based on the client's individual needs — not on carrier incentives, quotas, or bonus structures
Independence means you receive a genuine comparison of the plans available to you in your county — not a pitch for a single company's products.
Compensation Disclosure
Our advisory and enrollment services are provided at no direct cost to you. When you enroll in a health insurance plan through GenerationHealth, we receive compensation from the insurance carrier in the form of a commission or fee. This is the standard method by which independent agents and brokers are compensated in the health insurance industry.
Important: Broker compensation does not affect your plan premium. The monthly premium you pay is identical whether you enroll through an independent broker, directly with the carrier, or through HealthCare.gov or Medicare.gov. Using a broker costs you nothing additional.
In accordance with the Centers for Medicare & Medicaid Services (CMS) regulations effective for Medicare plan years, Robert Simm discloses the following regarding Medicare compensation:
- Compensation for Medicare Advantage and Medicare Part D plans is paid by insurance carriers and is set within CMS-established limits
- Compensation amounts are standardized and do not vary based on which specific plan within a carrier's portfolio a client selects
- Robert Simm may receive compensation for initial enrollments and for subsequent plan years in which the client remains enrolled (renewal compensation)
- Compensation does not create an obligation to recommend any particular carrier or plan
For ACA Marketplace plans, broker compensation is similarly paid by carriers and does not affect the subsidized or unsubsidized premium paid by the consumer.

CMS Medicare Marketing Compliance
GenerationHealth and Robert Simm comply with all applicable CMS Medicare marketing and communications regulations, including requirements established under the Medicare Improvements for Patients and Providers Act (MIPPA), the Bipartisan Budget Act, and subsequent CMS Final Rules governing Medicare Advantage and Part D marketing.
- All Medicare marketing materials are reviewed for CMS compliance before use
- Sales calls involving Medicare beneficiaries are recorded in compliance with CMS requirements — callers are notified at the start of each call
- Scope of Appointment (SOA) documentation is collected before Medicare sales appointments where required by CMS regulation
- We do not conduct unsolicited door-to-door solicitation or cold-call Medicare beneficiaries for sales purposes
- We do not conduct Medicare sales presentations at educational events
- We do not offer gifts, payments, or inducements to Medicare beneficiaries in exchange for enrollment
- We do not market non-health related products (such as annuities or life insurance) during a Medicare sales appointment without prior expressed consent
- All plan benefit information is presented in accordance with CMS-approved plan materials for the applicable plan year
- AHIP certification is maintained annually as required for Medicare plan sales

We are not licensed to sell insurance in any state other than North Carolina. Residents of other states should consult a licensed health insurance agent or broker in their own state.

Call Recording Disclosure
In compliance with CMS Medicare marketing regulations, telephone calls involving Medicare plan discussions or sales may be recorded. You will be notified at the beginning of any recorded call.
Call recordings are maintained for compliance purposes as required by CMS and applicable state regulations. Recordings are not shared with third parties except as required by law or regulatory audit processes.
If you do not wish for a call to be recorded, please notify us at the start of the call. Please note that CMS regulations may require recording of certain Medicare sales calls; we will advise you of any applicable requirements at the time.
North Carolina is a one-party consent state for call recording under NC Gen. Stat. § 15A-287. However, as a matter of practice and CMS compliance, we provide notification of recording to all callers regardless of state law requirements.

- No data selling: We do not sell, rent, or share your personal information with third-party lead buyers, telemarketers, or data brokers
- One broker model: When you contact GenerationHealth, your information is used solely by Robert Simm to assist you — not distributed to multiple agents or call centers
- Carrier data sharing: When you authorize enrollment in a plan, necessary information is shared with the selected carrier as part of the enrollment process. Such sharing is governed by that carrier's privacy practices and applicable law, including HIPAA where applicable
- Retention: Client records are retained as required by NC insurance regulations and CMS compliance requirements

Accuracy of Information
We make reasonable efforts to ensure that all information on GenerationHealth.me is accurate, current, and consistent with information published by CMS, NCDOI, and the relevant carriers. However:
- Medicare premiums, plan benefits, formularies, and cost-sharing amounts change annually on January 1 and may change mid-year for certain plan elements
- ACA Marketplace premiums, plan designs, and carrier availability change annually during Open Enrollment and may be affected by mid-year SEP events
- Federal Poverty Level thresholds and ACA subsidy calculations are updated annually
- Carrier network participation — which specific providers are in-network — can change at any time and must be verified directly with the carrier before enrollment
